Harris Farm Markets Pty Ltd (' Harris Farm Markets ') respects the privacy of individuals by treating all personal information as confidential and by handling it in accordance with the Privacy Act 1988 (Act) and the Australian Privacy Principles (APPs). We respect your right to privacy and understand the need to protect your personal information.
This Privacy Policy sets out how we manage your personal information that we collect about you. It also describes, in general terms, the types of personal information we hold, for what purposes and sets out how that information is collected, used, stored, secured, disclosed, and disposed of by Harris Farm Markets.

This Personal Information is obtained in many ways including interviews, correspondence, by telephone, by email, via our website www.harrisfarm.com.au, from media and publications, from other publicly available sources, from cookies and from third parties.
We collect your Personal Information for the primary purpose of providing our services to you, and marketing or for employment purposes. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

Collection from Third Parties
Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.
Collection using the Harris Farm Markets Website

By using the website, you are accepting the practices described in this privacy policy. Your personal information is not collected if you only browse this website: www.harrisfarm.com.au.
Collection of Your Personal Information
As a retailer of groceries, during the course of its activities, Harris Farm Markets will collect, use, and disclose personal information from:
- Customers who enter a Harris Farm Market stores. The stores may collect your personal information through their CCTV camera system, (including your image and the number plate of your vehicle) through their facial recognition system.
- Customers who use the online shopping facility.
- Visitors to and users of our website, including any user forums section of our website.
- Customers who enter trade promotions / competitions conducted by Harris Farm.
- Customers who register Harris Farm gift card details.
- Customers who call the Harris Farm customer service team or otherwise contact us.
This information can be collected:
- Directly from you.
- When you register as a user of the website.
- When you place an order via the website.
- Where you access and interact with the website or the customer service team, or from other sources.
- The information collected may include your name, mailing or residential address, telephone number, email address and other transaction and registration details.
- If you choose not to provide us with your personal information, we may not be able to provide the information, goods, or the service you may require, or to fulfil one or more other purposes of collection of your personal information.
- We do not collect your credit card or banking details as online payments are handled by NAB and Secure Pay. Please check the www.nab.com.au and www.securepay.com.au websites for details of their privacy policies and security measures.
Harris Farm will also collect information form supplier s and contractors for the purpose of those contractors and suppliers providing services to Harris Farm.
Facial Recognition
This section sets out how a FR Store will collect, use and protect personal information collected using that store’s FR System.
How will I know it’s a FR Store?
Each FR Store will have signage to notify you that it uses facial recognition technology in its store. If you do not want your personal information to be collected by the FR System, please do not enter a FR Store.
What type of personal information will a FR Store collect using its FR System?
A FR Store will collect facial images of everyone entering that store. The store’s FR System will convert these facial images into a digital code called a ‘biometric template’ and will compare that biometric template with those of individuals who that store has previously identified as a person of interest (as defined below). If your facial image does not match with the image of a person of interest, your image and associated biometric template will be automatically deleted from the FR System immediately.
The FR Store may also collect and save your image from its CCTV system into its FR System if the store reasonably believes that you are a person of interest.
A person of interest is:
-
individual has been formally notified that they are prohibited from entering a store, resulting in a prohibition notice being issued in Australia
person of interest (POI) is reasonably suspected of:
-
serious criminal conduct such as theft or fraud; or
-
documented actual or threatened violence against a team member or customer on HFM premises.
If you are a person of interest, stores may also collect the following personal information:

your name;
-
a description of the incident; and
-
a prohibition notice reference ID.
How long will personal information be kept in a FR Store’s FR System?
Where the FR System does not find a match between the collected facial image and a person of interest, then the collected facial image (and associate template) is immediately and automatically deleted.
Where the FR System finds a match and that match is verified by specially trained staff as a person of interest, it will store images of offenders until no longer deemed a threat to Harris Farm Markets.
Will personal information collected by a FR Store’s FR System be disclosed to anyone else?
Personal information collected by a FR Store’s FR System will only be disclosed to:
-
specially trained store personnel with a legitimate need-to-know;
-
Harris Farm Markets and its service providers for the purpose of assisting the FR Store with operating its FR System; and
-
law enforcement where compelled to do so by law.
Please note that FR Stores cannot access or extract biometric templates from their FR Systems.
Can I request removal of my image from the FR system?
In certain circumstances, a FR Store can remove an individual that is a person of interest from its FR System. All other images are automatically deleted from the FR System if there is no match.
If you wish to query your enrolment in the FR System as a person of interest, or if you have any other questions, please email info@harrisfarm.com.au.
If you wish to request the removal of your information/image from the FR system, please set out in your email: (i) the store the incident took place in, (ii) the date and time of the incident, (iii) what happened, and (iv) the reasons why your information/image should be removed from the FR system. HFM will then consider your request by reviewing the information you have provided, including assessing it against the information it has relating to the incident.
How do I access or update my personal information held in a FR Store’s FR System?
You may submit a request to access and correct any personal information held about you by a FR Store directly to that store or by emailing info@harrisfarm.com.au.
Disclosure of Personal Information
Personal information is used by Harris Farm for its legitimate business purposes, as notified at the time of collection. It is also used for ancillary purposes such as locating and identifying customers or otherwise servicing Harris Farm's relationship with its customers.
USE AND DISCLOSURE OF PERSONAL INFORMATION
You acknowledge and consent that by providing your personal information to us that we may use and disclose your personal information for the purposes for which it was collected or for a related or ancillary purpose such as:
a) to facilitate and process your order.
b) to carry out or respond to your requests.
c) to our third-party service providers to assist us in providing and improving our services to you, and to analyse trends in sales and better understand our customer’s needs or to develop and improve market our products and services to you.
d) for regulatory reporting and compliance with our legal obligations.
e) to our third-party service providers for use in direct marketing of promotions, product, and services we think may interest to you.
f) to seek your feedback in relation to customer satisfaction and our relationship with you.
OUR USE OF COOKIES

However, most of the Personal Information is or will be stored in customer files which will be kept by us for a minimum of 7 years.

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.
Harris Farm Markets will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information.
To protect your Personal Information, we may require identification from you before releasing the requested information.
Your right to access your personal information as held by Harris Farm Markets is subject to certain exceptions allowed by law. Your right to access your personal information may be affected by matters such as:

If Harris Farm Markets denies you access to your personal information, we will provide a reason.
Other than the above, we will not disclose your personal information without your consent unless disclosure is either necessary to prevent a threat to life or health, authorised or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity.
Any permitted handling of personal information under any exemptions under the Act will take priority over this Privacy Policy to the extent of any inconsistency.

TRANSMISSION OF YOUR DATA
While care is taken to protect your personal information on the website, unfortunately no data transmission over the Internet is guaranteed as 100% secure. Accordingly, we cannot ensure or warrant the security of any information you send to us or receive from us online. This is particularly true for information you send to us via email as we have no way of protecting that information until it reaches us. Once we receive your personal information, we protect it in accordance with the Act.

It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete, and up to date. Harris Farm Markets acknowledges and respects its customers' choice to "opt-out" of direct marketing communication activities undertaken by Harris Farm Markets. If as a customer you do not wish to receive promotional material from Harris Farm Markets, please contact Harris Farm and indicate the promotional material you do not wish to receive.
